TERMS AND CONDITIONS

Detailed herewith are the terms and conditions of Mr David Kirby which apply to all work undertaken unless otherwise agreed in writing. ‘Contract’ means the contract between Mr David Kirby and the Instructing Solicitor / Local Authority (in the case of a Coroner) or Agent as set out in these terms.

FEES

You agree to pay Emergency Medicine Expert Reports Ltd. charges calculated on the basis of the hourly rates applicable at the time of supply.

You also agree to pay for any out of pocket expenses incurred in supplying services. Current rates are detailed as follows:

SCHEDULE OF FEES FOR LEGAL WORK

• Preparation of Case reports and administration £200 per hour
• Attendance at Case Conferences, Meetings of experts & participation in any telephone conferences £200 per hour
• Travel time to visit clients, attend meetings, Case Conferences and Court £100 per hour
• Mileage charge for private car £0.45 per mile
• Expenses, such as trains, accommodation etc. (Receipts will be provided) Charged at cost

COURT ATTENDANCE

Court attendance £1200 per full day £800 per ½ day

Attendance is charged for a minimum of half a day. If the length of appearance exceeds four hours, then a full day charge will be made. Length of appearance will commence at the required time of arrival and end at the time of release as a witness. These charges are applicable to live evidence in court, whether in person or via video-link.

CANCELLATION CHARGES FOR PREVIOUSLY AGREED COURT OR CONFERENCE ATTENDANCE:

Within four weeks notice: Full-day fee

Within one week of attendance: Half-day fee

ABORTIVE WORK

A fee is charged for all work, visits or other services requested even if that element of service proves to be abortive or otherwise ineffective.

PAYMENT OF FEES BY THE SOLICITOR/COUNCIL

Within six weeks of date of posting my report, even if the case is legally aided. In the case of Public bodies this can be extended to 90 days.

This is part of the agreement of my accepting the case.
